Terms & Conditions

← Back to Bestlearn

These terms are intended for Bestlearn's UK online tutoring service. They should be reviewed if Bestlearn's legal structure, payment model or services change.

These Terms & Conditions apply to tutoring and educational support services provided by Bestlearn (“Bestlearn”, “we”, “us” or “our”). By booking or purchasing tuition from Bestlearn, the parent, guardian or adult student (“you” or “the Customer”) agrees to these Terms & Conditions.

1. Our Services

Bestlearn provides personalised online tuition and educational support, including one-to-one tuition, exam preparation, SEN-supportive tuition and other academic support. Services may include Weekly programmes, Intensive programmes and other individually agreed tuition arrangements. The exact subjects, frequency of lessons, tuition level, price and programme will be agreed with the Customer before paid tuition begins.

2. Students Under 18

Where a student is under 18, the person entering into the agreement with Bestlearn must be their parent, legal guardian or another adult with appropriate authority to arrange tuition for the student. The parent or guardian is responsible for providing accurate information necessary for Bestlearn to arrange appropriate tuition.

3. Tutors

Bestlearn will take reasonable steps to match each student with an appropriate tutor based on factors including subject, academic level, availability and learning requirements. Where stated by Bestlearn, tutors working with children will have appropriate safeguarding checks, including DBS checks where applicable. Bestlearn may change the assigned tutor where reasonably necessary.

4. SEN and Additional Learning Support

Bestlearn aims to provide inclusive and adaptable tuition. Parents and guardians are encouraged to tell us about learning needs, reasonable adjustments or teaching approaches that may help the student. Bestlearn provides educational support and does not provide medical diagnosis, clinical treatment, therapy or specialist healthcare services.

5. Fees and Quotations

Tuition fees will be confirmed before the Customer commits to a paid programme. Prices may depend on academic level, subject, frequency of tuition, programme intensity, tutor requirements and additional agreed support. A quotation may have an expiry date. Bestlearn will not increase an already agreed price retrospectively.

6. Payments

Payments may be processed through an authorised third-party payment provider such as Stripe. Bestlearn does not directly store full debit or credit card details. The Customer is responsible for ensuring payments are made when due. Where recurring payments are agreed, the payment frequency and amount will be explained before the Customer commits.

7. Booking and Lesson Times

Lesson times will be agreed between Bestlearn, the tutor and the Customer. Customers should ensure the student is available at the agreed time, has a suitable internet connection and device, has access to required learning materials and joins promptly. A lesson may still end at its originally scheduled time where a student joins late.

8. Customer Cancellations and Rescheduling

Where possible, Customers should provide at least 24 hours' notice if a lesson needs to be cancelled or rescheduled. With sufficient notice, Bestlearn will normally attempt to reschedule subject to tutor availability. With less than 24 hours' notice, Bestlearn may charge for some or all of the lesson where it has incurred a genuine loss that cannot reasonably be avoided. Exceptional circumstances will be considered individually.

9. Missed Lessons

If a student does not attend an agreed lesson without notice, the lesson may be treated as delivered where the tutor was available and Bestlearn could not reasonably reallocate the tutor's time. Where technical problems caused by Bestlearn or the tutor prevent a lesson from taking place, Bestlearn will normally arrange a replacement lesson or an appropriate refund or credit.

10. Cancellation by Bestlearn or a Tutor

If Bestlearn or the assigned tutor needs to cancel a lesson, we will aim to provide as much notice as reasonably possible. The lesson will normally be rescheduled, credited towards a future lesson or refunded where appropriate.

11. Cooling-Off Rights

Where a Customer enters into a qualifying distance contract with Bestlearn, statutory cancellation rights may apply. In applicable circumstances, Customers generally have 14 days from entering into the contract to cancel without giving a reason. If the Customer specifically requests that tuition begins during that period, Bestlearn may begin providing the service. If the Customer later cancels during that period after tuition has begun at their request, they may be required to pay a proportionate amount for services already supplied where permitted by law. Nothing in these Terms removes or limits statutory consumer rights.

12. Refunds

Refund requests will be considered according to services already provided, lessons already delivered, unavoidable costs reasonably incurred, applicable consumer rights and the circumstances of the cancellation. Bestlearn does not operate a blanket “no refunds” policy. Where Bestlearn cannot provide a paid service and no suitable alternative can be agreed, the Customer will normally receive an appropriate refund for the undelivered service.

13. Weekly and Intensive Programmes

A Weekly programme provides ongoing tuition at an agreed frequency. An Intensive programme provides higher-frequency or more concentrated academic support over an agreed period. The exact number and frequency of lessons are determined individually and confirmed before payment. Purchasing an Intensive programme does not guarantee a particular examination result, grade, school admission or academic outcome.

14. Academic Results

Bestlearn and its tutors will use reasonable skill and care in providing tuition. Academic performance depends on many factors outside Bestlearn's control, including attendance, effort, independent study, school teaching and examination performance. Bestlearn therefore cannot guarantee specific grades, examination results, university offers or school admissions.

15. Appropriate Behaviour

Students, parents, guardians and tutors are expected to communicate respectfully. Bestlearn may suspend or terminate services in serious cases involving abusive, threatening or discriminatory behaviour, harassment, safeguarding concerns, inappropriate communications, deliberate misuse of the service or persistent non-payment.

16. Safeguarding

The safety and welfare of students is important to Bestlearn. Tutors must maintain appropriate professional boundaries with students. Safeguarding concerns may be recorded, escalated or disclosed to appropriate persons or authorities where Bestlearn reasonably believes this is necessary or legally required.

17. Lesson Recording

Online lessons will not be recorded by Bestlearn unless the Customer has been informed and an appropriate lawful basis and safeguarding process are in place. Students and Customers should not record tutors or lessons without prior permission.

18. Intellectual Property

Learning materials provided by Bestlearn or its tutors remain the intellectual property of their respective owners unless otherwise stated. Materials supplied for tuition may be used by the student for personal educational purposes but must not be commercially reproduced, resold, distributed or published without permission.

19. Complaints

If you are unhappy with any aspect of our service, contact info@bestlearn.co.uk and provide sufficient information for us to investigate. We aim to acknowledge complaints promptly and resolve them fairly.

20. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful. Bestlearn is not responsible for losses arising from circumstances outside our reasonable control, subject always to the Customer's statutory rights.

21. Changes to These Terms

Bestlearn may update these Terms from time to time. Material changes affecting existing Customers will be communicated where appropriate. Changes will not retrospectively remove rights already acquired by a Customer.

22. Governing Law

These Terms are governed by the applicable laws of England and Wales. Customers retain any mandatory consumer rights relating to jurisdiction that apply to them.
